LGPD and the People Counter

Quick Summary:

Here are a few examples on how to protect yourself from potential issues with the new LGPD when using analytics and data services in retail.

Retail Analytics and the LGPD

Did you know it can be a crime to store certain data from your store? Even though we provide you with metrics to improve your sales, it’s necessary to follow specific rules to ensure all data protection laws are respected.

By law, certain captured data cannot be stored without consent, especially sensitive or personally identifiable information. With AlterVision's software, after image analysis, only anonymous data is extracted—no individual can be identified. This allows us to perform statistical analysis and generate insights anonymously. The relevant law is the LGPD (General Data Protection Law), which we've discussed before and are strongly committed to following. Compliance is not optional, and recently, fines and lawsuits have been imposed on major retailers for violating this law.

People Counters and Anonymous Data

When a person enters a store, the challenge is to convert an image into a meaningful data point. However, only certain data can be captured because anonymity must be preserved. For example:

Sensitive Personal Data: race, religion, disabilities, political views, and tattoos.

Anonymous Data: gender, age range, apparent emotion, visit time, and dwell time.

In other words, if you enter a store using our LGPD-compliant system, the only information the retailer receives is your gender, an approximate age range, whether you appear happy or not, how long you stayed, etc. All of this data is anonymous. We won’t know if you have tattoos, your race, the clothes you wear, or any other personal or sensitive detail.

Important Facts About Us:

  1. We do NOT support any form of mobile tracking and do not use such algorithms, which are commonly used by others.
  2. We do NOT perform facial recognition—none of AlterVision’s algorithms involve facial recognition.
  3. We do NOT recognize race, skin color, or ethnicity.
  4. AlterVision does NOT store any images or user identifiers.
  5. We are fully committed to and will always comply with the General Data Protection Law.
  6. The ONLY piece of information stored by AlterVision is a number that logs a person’s path at a specific time. We do not know who that person is, whether they have a phone, or any information about race, religion, or face.

A store using AlterVision's systems is a safe environment fully compliant with data protection standards. Share this message with retailers in your network and help build a more responsible, innovative, and privacy-conscious retail market!
